RETURNS, EXCHANGES & REFUND POLICY

At No Pressure Underwear, customer satisfaction and product hygiene are important to us. Because we sell bras and other intimate apparel, special hygiene requirements apply to voluntary returns and exchanges.
This Returns, Exchanges & Refund Policy applies to purchases made from No Pressure Underwear through our online store.
This policy is intended to operate in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
Nothing in this policy is intended to exclude, restrict, waive or limit any consumer right that cannot lawfully be excluded or limited. If any provision of this policy conflicts with a mandatory provision of South African law, the applicable law will prevail.
1. INTIMATE APPAREL & HYGIENE
Our products are intimate garments and are therefore subject to strict hygiene standards.
Customers should take reasonable care when trying on a No Pressure Bra and should avoid contact with makeup, deodorant, perfume, lotions, body oils and other substances.
For voluntary returns or exchanges that are not required by law, No Pressure Underwear reserves the right, to the fullest extent permitted by applicable law, to refuse a return or exchange if:
-
the garment has been worn beyond what is reasonably necessary to inspect or assess its fit;
-
the garment has been washed;
-
the garment is stained, marked, soiled or damaged;
-
the garment smells of perfume, deodorant, smoke, body odour or other substances;
-
the garment contains makeup, tanning products, lotions, body oils or similar marks;
-
the garment has been stretched, altered, cut or modified;
-
any tags or labels have been removed;
-
any applicable hygiene seal or protective packaging has been removed, broken or tampered with; or
-
the garment is otherwise not in a condition reasonably suitable for hygienic resale.
These restrictions apply to voluntary returns only to the extent permitted by law.
They do not remove or restrict a customer's statutory rights relating to defective, unsafe, incorrectly supplied or otherwise non-compliant goods.
2. VOLUNTARY CHANGE-OF-MIND RETURNS
Except where a return is required by applicable law, No Pressure Underwear does not have to accept a return merely because a customer has changed their mind.
However, as an additional customer service benefit, we may accept eligible change-of-mind returns if the customer contacts us within 14 days after delivery.
To qualify under our voluntary return policy, the product must:
-
be unworn other than reasonably necessary fitting;
-
be unwashed;
-
be clean, unmarked and undamaged;
-
have all original tags and labels attached;
-
have any applicable hygiene seal intact;
-
contain all accessories supplied with it; and
-
be returned in its original packaging and in a condition reasonably suitable for resale.
We reserve the right to inspect returned products before approving a voluntary refund or exchange.
If a voluntary return does not satisfy these requirements, we may refuse the return to the extent permitted by law.
This section does not limit any statutory return right that applies to the transaction.
3. RETURN COSTS FOR VOLUNTARY RETURNS
Unless applicable law requires otherwise, customers are responsible for the cost of returning products where:
-
they changed their mind;
-
they ordered the wrong size;
-
they selected the wrong colour;
-
they no longer want the product; or
-
the return is otherwise voluntary and is not caused by a fault attributable to No Pressure Underwear.
Original delivery fees are not refundable for voluntary returns except where required by applicable law.
Any additional delivery costs associated with an approved voluntary exchange may also be payable by the customer.
4. ONLINE PURCHASES & ECTA COOLING-OFF RIGHTS
Certain electronic transactions may qualify for the cooling-off right provided by section 44 of ECTA.
Where section 44 applies, a consumer may cancel an eligible transaction for the supply of goods without reason and without penalty within seven (7) days after receiving the goods.
Where this statutory cooling-off right applies:
-
the customer does not need to provide a reason for cancellation;
-
the customer may be responsible for the direct cost of returning the goods, as permitted by ECTA; and
-
No Pressure Underwear will provide the refund required by ECTA within the legally prescribed period.
The cooling-off right is subject to the exclusions contained in ECTA. Nothing in this policy is intended to expand, restrict or remove those statutory exclusions.
Where a product or transaction falls within a statutory exclusion, the cooling-off right may not apply.
5. DEFECTIVE, UNSAFE OR POOR-QUALITY PRODUCTS
The hygiene and voluntary-return restrictions in this policy do not remove a customer's statutory rights regarding defective goods.
Under sections 55 and 56 of the CPA, goods supplied to consumers are subject to statutory quality requirements and an implied warranty of quality.
Where a product fails to satisfy the applicable statutory requirements within six (6) months after delivery, the consumer may, where section 56 of the CPA applies, return the product without penalty and at the supplier's risk and expense.
Where the CPA gives the consumer the choice of remedy, the consumer may direct No Pressure Underwear to:
-
repair the product;
-
replace the product; or
-
refund the price paid for the product.
No Pressure Underwear will not unlawfully substitute its preferred remedy where applicable law gives the choice to the consumer.
We may reasonably inspect a returned product to determine the nature and cause of the reported issue. Such inspection will not be used to unlawfully delay or deny a legitimate statutory claim.
6. WHAT IS NOT GENERALLY CONSIDERED A PRODUCT DEFECT
To the extent permitted by applicable law, a product problem will not ordinarily qualify as a manufacturing defect where it results from circumstances arising after the product left our control, including:
-
normal wear and tear;
-
failure to follow the supplied care or washing instructions;
-
washing at an inappropriate temperature;
-
tumble drying where prohibited by the care instructions;
-
use of bleach or unsuitable cleaning chemicals;
-
misuse or abnormal use;
-
accidental damage;
-
deliberate damage;
-
cutting or altering the garment;
-
damage caused by jewellery, sharp objects or other external items;
-
incorrect storage;
-
damage caused by the customer after delivery; or
-
alterations contrary to supplied instructions after the product left our control.
A customer ordering the incorrect size does not, by itself, make a correctly supplied and accurately described product defective.
Similarly, a personal preference regarding fit, colour or style does not by itself establish a defect where the product was accurately described and supplied as ordered.
Nothing in this section excludes liability for a defect or failure for which No Pressure Underwear remains legally responsible.
7. INCORRECT PRODUCT, SIZE OR COLOUR SENT BY US
If No Pressure Underwear sends a product that is materially different from the customer's order—for example, the wrong product, size or colour—the customer should contact us as soon as reasonably possible.
Please provide:
-
the order number;
-
the customer's full name;
-
a description of the problem; and
-
clear photographs of the item and packaging where reasonably possible.
Where the customer is legally entitled to reject incorrectly supplied goods, No Pressure Underwear will provide the appropriate remedy and bear the return costs where required by applicable law.
8. WRONG SIZE ORDERED BY THE CUSTOMER
Customers are responsible for reviewing our sizing information before placing an order.
Where the customer selects and orders the wrong size and we correctly supply the size ordered, this will ordinarily be treated as a voluntary size exchange or change-of-mind return, rather than a defective-product claim.
The garment must satisfy the hygiene and return-condition requirements in this policy for a voluntary exchange to be approved.
Unless applicable law provides otherwise, the customer may be responsible for:
-
return shipping; and
-
delivery of the replacement product.
Exchanges are subject to stock availability.
9. SALE, DISCOUNTED & PROMOTIONAL PRODUCTS
Products purchased during a sale or promotion remain protected by all mandatory rights provided by South African law.
A discounted price does not remove statutory rights concerning defective, unsafe or otherwise non-compliant goods.
However, where no statutory right to return exists, No Pressure Underwear may impose reasonable conditions on voluntary returns of sale or promotional items where those conditions were appropriately disclosed.

Products should not be sent to an address shown on the original shipping packaging unless we confirm that it is the correct returns address.
11. RETURN SHIPPING
For approved voluntary change-of-mind, customer-selected size or colour returns, the customer is responsible for return shipping unless otherwise agreed or required by law.
Where a product is defective, unsafe, incorrectly supplied or otherwise qualifies for a return at our expense under applicable law, No Pressure Underwear will bear the return risk and expense as required by law.
Customers arranging their own return shipment should retain proof of postage or tracking information until the return has been resolved.
No Pressure Underwear is not responsible for voluntary returns lost in transit where the customer selected and arranged the return carrier, except to the extent applicable law provides otherwise.
12. INSPECTION OF RETURNED PRODUCTS
Where appropriate, returned products may be inspected to confirm:
-
that the correct product was returned;
-
the condition of the product;
-
whether a voluntary return satisfies our hygiene requirements; and/or
-
the nature and possible cause of an alleged defect.
For voluntary returns, we reserve the right to refuse a return that does not satisfy this policy.
For statutory returns, inspection will not be used to remove, restrict or delay a consumer right contrary to applicable law.
13. REFUNDS
Where a refund is approved or legally required, it will ordinarily be made using the original payment method unless another method is required by law or agreed with the customer.
Payment processors and financial institutions may require additional time for the refunded amount to appear in the customer's account after we have processed it.
Where applicable legislation specifies a refund deadline, the statutory deadline will apply.
14. EXCHANGES
Eligible products may be exchanged for another available size or colour where:
-
the return satisfies this policy;
-
the product qualifies for exchange under applicable law; or
-
we otherwise agree to the exchange.
All voluntary exchanges are subject to stock availability.
If a requested voluntary replacement is unavailable, we may offer an alternative product, store credit or refund, as appropriate and subject to applicable law.
Where the CPA or another law gives the consumer the right to choose a particular remedy, this section does not override that choice.
15. REFUSED, UNCLAIMED OR UNDELIVERABLE ORDERS
Customers are responsible for providing complete and accurate delivery information when placing an order.
Where a parcel is returned because:
-
an incorrect address was supplied by the customer;
-
the customer failed to collect it;
-
delivery was repeatedly unsuccessful for reasons attributable to the customer; or
-
the customer refused delivery without exercising a lawful cancellation or rejection right,
No Pressure Underwear may, to the extent permitted by law, recover or deduct reasonable costs actually incurred in connection with the failed delivery, return or re-delivery.
This provision does not apply where applicable law requires No Pressure Underwear to bear those costs.
16. FRAUDULENT & ABUSIVE RETURN CLAIMS
No Pressure Underwear reserves the right to investigate suspected fraudulent or abusive return activity.
To the extent permitted by law, we may reject a claim where there are reasonable and lawful grounds to establish that:
-
a different product has been returned;
-
the product was deliberately damaged;
-
the product was materially altered after delivery;
-
information supplied in support of the claim is fraudulent;
-
a return has been manipulated or falsified; or
-
the claim otherwise constitutes fraud or abuse.
We may preserve relevant records and take appropriate lawful action in cases of suspected fraud.
This provision will never be used to deny a legitimate statutory consumer claim.
17. CANCELLATIONS BEFORE DISPATCH
Customers who wish to cancel an order should contact us as soon as possible.
If fulfilment can reasonably be stopped before dispatch, we may cancel the order and refund the applicable amount.
If an order has already been dispatched, the cancellation and return rights provided by this policy and applicable South African law will apply.
Any statutory right concerning cancellation of an advance order remains unaffected.
18. PROOF OF PURCHASE
We may reasonably request an order number, receipt or other information allowing us to verify that the product was purchased from No Pressure Underwear and identify the relevant transaction.
This requirement will not be applied in a manner that unlawfully prevents a consumer from exercising a statutory right where satisfactory alternative proof of purchase exists.
19. FAIR USE OF THIS POLICY
Our voluntary returns programme is intended for genuine purchases.
Where permitted by law, No Pressure Underwear reserves the right to limit or refuse voluntary return privileges in cases involving persistent or demonstrably abusive return behaviour.
This does not affect mandatory rights under the CPA, ECTA or other applicable legislation.
20. CHANGES TO THIS POLICY
No Pressure Underwear may amend this policy from time to time to reflect changes to our operations or applicable law.
Any amendment will not retrospectively remove statutory rights that have already accrued to a customer.

YOUR SOUTH AFRICAN CONSUMER RIGHTS
This policy provides No Pressure Underwear's procedures for returns, exchanges and refunds. It does not replace your rights under South African law.
Nothing in this policy is intended to waive, exclude, restrict or override any right or remedy that a consumer is entitled to under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African legislation.
Where a provision of this policy conflicts with a mandatory consumer protection requirement, the mandatory legal requirement will prevail.
